1. Acceptance

By accessing or using ParkCharm (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service. Your continued use after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to create an account. If you are using the Service on behalf of a party that includes minors, you represent that you are the responsible adult for that party and accept these Terms on their behalf.

3. Description of Service

ParkCharm is an AI-powered Disneyland itinerary planner and day-of optimization tool. It ingests your preferences, party composition, and constraints and produces a suggested ride order, meal timing, and Lightning Lane / Genie+ booking strategy. The Service then adapts your plan in real time based on observed wait times and your check-ins at attractions.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hankbon@gmail.com if you suspect unauthorized access.

All software, designs, text, and branding that make up the Service (excluding your user content) are owned by the Service operator and are protected by copyright and trademark law. You receive a limited, non-exclusive, non-transferable license to use the Service for personal trip planning only.

6a. SMS Program

ParkCharm operates a transactional SMS program for plan invitations. By using the in-app invite flow to send an SMS invite, the inviter represents that they have the recipient's permission to receive the invite. The program is governed by the following terms:

We are not affiliated with, endorsed by, or sponsored by The Walt Disney Company, Disney Enterprises, Inc., or any of their subsidiaries or affiliates. All trademarks (Disneyland, Disney California Adventure, Lightning Lane, Genie+, etc.) are the property of their respective owners.

Wait time predictions are estimates based on historical data and your actual experience may vary. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, the Service operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost vacation time, unused park tickets, or missed attractions, arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless the Service operator from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, suspected fraud, or at our discretion. You may close your account at any time by contacting us; refund eligibility is governed by the Refund Policy.

11. Changes to These Terms

We may revise these Terms from time to time. Material changes will be announced via the Service or by email. Continued use after the effective date of a revision constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws provisions. Any dispute shall be resolved in the state or federal courts located in Orange County, California.
